Thank you for visiting the platform of Biximo Baby (“Biximo”, “Company”, “we”, “us” or “our”). Users, customers, visitors and vendors are collectively referred to as “you”, “your” or “user”.

By using or accessing the website www.biximo.in (“Website”), other sub-domains together with our mobile applications, business messaging channels and any other digital property operated by us (collectively, the “Platform”), or by submitting your information to us, you confirm that you are legally capable of entering into a binding contract under the Indian Contract Act, 1872, and that you agree with the privacy practices described in this document (“Privacy Policy”) and with our Terms of Use.

This Privacy Policy sets out how Biximo collects, uses, shares, stores, retains and protects your personal data. It is issued as a notice under Section 5 of the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Digital Personal Data Protection Rules, 2025 (“DPDP Rules”), and is to be read together with our Terms of Use, of which it forms part. If you do not agree with any part of this Privacy Policy, please do not use or access the Platform.

This document is an electronic record in terms of (i) the Information Technology Act, 2000 (“IT Act”); (ii) the rules framed thereunder as applicable; and (iii) the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signature.

Biximo reserves the right to change, modify, add to or delete portions of this Privacy Policy at any time. Where a change is material including the introduction of a new purpose of processing, a new category of recipient, or a change in retention period. Biximo will notify you by email or by a notice on the Platform before the change takes effect and will revise the date stated above. You are responsible for reviewing this page periodically. Your continued use of the Platform following any change constitutes your acceptance of the revised Privacy Policy.

If you are accessing or using the Platform from a location outside India, you do so at your own risk and shall be solely responsible for compliance with any applicable local laws.

The Platform may contain links to external websites. Information collected when you visit such websites is not governed by this Privacy Policy. You should exercise caution and review the privacy policies of those websites before accessing them. You acknowledge that Biximo is not responsible for, and has no control over, the practices or content of any third-party website accessed through a link on the Platform.

1. COLLECTION OF USER INFORMATION

Biximo collects only such information as is necessary for the purposes set out in Clause 2. Biximo may collect the following:

  1. Identity and contact information: Your name, mobile number, email address, delivery address, billing address and postal code, provided by you when you place an order, create an account, subscribe to a mailing list, join a waitlist, register a warranty or contact us.
  2. Order and transaction information: Details of the products you order, order value, order and invoice history, delivery status, and records of returns, exchanges, refunds and quality inspection outcomes.
  3. Payment information: Transaction references, payment status, payment method and a masked card identifier, received from the payment service provider through which your payment is processed. Biximo does not receive, see or store your full card number, card verification value, personal identification number, unified payments interface credentials, net banking password or any one-time password. Where a refund is due on a cash-on-delivery order, Biximo collects your bank account name, account number and IFSC solely for the purpose of effecting that refund.
  4. Warranty and service information: Warranty registration details, product serial or batch identifiers, and a record of service requests, inspections and resolutions.
  5. Information relating to a child: Where you voluntarily provide it, the age, date of birth, height or weight of a child, and, where you submit a review, photograph or video, the image or likeness of a child. The provision of such information is entirely optional and is not a condition of purchase. Clause 4 sets out the additional protections that apply.
  6. Content submitted by you: Reviews, ratings, questions, comments, photographs, videos and social media content in which you tag us, together with the display name, handle or city you choose to publish it under.
  7. Technical and usage information: Your internet protocol address, device type, operating system, browser type and version, referring uniform resource locator, the pages you view, the search terms you enter on the Platform, cart and wishlist activity, and the dates and times at which the Platform is accessed.
  8. Communications information: Correspondence with our customer support team by email, business messaging channel or telephone, including transcripts and call notes. Where a call is recorded, you will be informed at the commencement of the call.
  9. Marketing and preference information: Your consent status in respect of email, short message service and business messaging communications, your subscription and waitlist entries, and your engagement with our campaigns.

Biximo does not collect information relating to your religion, caste, political affiliation, sexual orientation, biometric identifiers, health records, or any government-issued identification number, and you are requested not to submit such information to us.

Information is collected directly from you; automatically through cookies and server logs when you use the Platform; from the service providers engaged by Biximo to fulfil your order or process your payment; and from publicly available sources where you have chosen to make information public.

2. USAGE OF USER INFORMATION

Your information will be used by Biximo only for the purposes for which it was collected, being:

  1. to establish, maintain and administer your account and your relationship with Biximo;
  2. to process, fulfil and deliver your order, and to send order confirmations, invoices and delivery updates;
  3. to verify orders and delivery details, and to prevent, detect and investigate fraud, coupon or offer misuse and unauthorised transactions;
  4. to process cancellations, returns, exchanges and refunds, including quality inspection of returned products;
  5. to honour warranty obligations, and to contact you in relation to a product safety notice, corrective action or recall;
  6. to provide customer support and to receive, investigate and resolve any complaint, claim or dispute;
  7. to recommend a product stage, size or configuration suited to your requirements, where you have provided information enabling us to do so;
  8. to send technical notices, security alerts and administrative or legal communications relating to the services;
  9. to operate, secure, maintain, measure and improve the Platform and the products and services offered on it;
  10. to send promotional and marketing communications, where you have consented to receive them;
  11. to publish content submitted by you, in accordance with the licence set out in our Terms of Use;
  12. to comply with applicable law, including the maintenance of statutory accounting, taxation and product compliance records, and to respond to a lawful request from a competent authority; and
  13. to establish, exercise or defend a legal claim.

Biximo will not use your information for any purpose materially different from those stated above without first providing you notice and, where required, obtaining your consent.

3. CONSENT AND WITHDRAWAL OF CONSENT

Your consent is sought at the point at which your information is collected, by a clear affirmative action, and is limited to the purposes specified in Clause 2. Where Biximo processes your information for a legitimate use permitted under Section 7 of the DPDP Act, including information you voluntarily provide for a purpose you have not objected to, or processing required to comply with a legal obligation, consent is not additionally sought.

You may withdraw your consent at any time, by writing to support@biximo.in by using the unsubscribe facility in any marketing communication, or by replying to any promotional short message service communication with the word STOP. Withdrawing consent is as simple as giving it, and no fee is charged.

The consequences of withdrawal are as follows. Biximo will cease the processing to which the withdrawal relates within a reasonable period, and will require its service providers to do likewise. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal. Biximo may continue to retain and process such information as it is required to retain under applicable law, or as is necessary to establish, exercise or defend a legal claim. Where consent is withdrawn in respect of information necessary to fulfil an order that has been accepted but not yet completed, Biximo may be unable to complete that order.

4. PROCESSING OF INFORMATION RELATING TO A CHILD

The Platform is intended for use by adults. You must be 18 years of age or older to purchase from Biximo or to hold an account with us. Under the DPDP Act, a child is any individual who has not attained the age of eighteen years.

  1. Verifiable consent of the parent or lawful guardian: Where you provide Biximo with any information relating to a child, you do so in your capacity as that child’s parent or lawful guardian, and you confirm that you have the authority to consent on that child’s behalf. Biximo adopts appropriate technical and organisational measures to ensure that such consent is obtained, and exercises due diligence to satisfy itself that the individual identifying themselves as the parent or lawful guardian is an identifiable adult. For this purpose Biximo may rely upon information reliably available to it as a consequence of your relationship with us, upon identity or age details voluntarily provided by you, or upon a virtual token issued by an entity authorised for that purpose.
  2. Content depicting a child: Where you submit a photograph or video in which a child appears, Biximo requires you to confirm parental or guardian consent at the point of submission, separately from your acceptance of our Terms of Use. Biximo may decline to process or publish any content where it is not satisfied that such consent has been given.
  3. Prohibited processing: Biximo does not track a child, monitor the behaviour of a child, or undertake any profiling of a child. Biximo does not direct advertising at children, and configures its advertising audiences on all platforms to reach adults only. Biximo does not process information relating to a child in any manner likely to cause a detrimental effect on the wellbeing of that child.
  4. Persons with disabilities: The protections in this Clause apply equally to the processing of information relating to a person with a disability who has a lawful guardian, where such processing is undertaken based on that guardian’s consent.
  5. Withdrawal and erasure: You may withdraw consent in respect of a child’s information, or request its erasure, at any time by writing to the Data Protection Officer. Biximo will give effect to such a request within ninety days of receipt and ordinarily within a few working days. Where content has been published, Biximo will remove it from channels under its control; content already reproduced by third parties may persist outside our control, and Biximo will inform you where that is the case.

5. DISSEMINATION OF USER INFORMATION

Where the fulfilment of any order or the provision of any service requested by you involves a third party, such information as is reasonably necessary may be shared with that third party, and Biximo may receive information from that third party in relation to the performance of that service.

Biximo shares information only with the following categories of recipient, and only to the extent necessary:

  1. Logistics and fulfilment service providers, including warehousing, packing and courier partners, for the purposes of dispatch, delivery, cash-on-delivery collection, reverse pickup and returns processing;
  2. Payment service providers, card issuers and lenders, for the purposes of processing payments, equated monthly instalment facilities and refunds;
  3. Technology and infrastructure providers, including platform hosting, data storage, communications, analytics and advertising service providers;
  4. Professional advisers, including chartered accountants, auditors and legal counsel, where required for compliance or advice;
  5. Judicial, regulatory and governmental authorities, where information is lawfully sought from Biximo pursuant to applicable law; and
  6. A third-party business entity, in the event of any proposed merger, acquisition, reorganisation, amalgamation, restructuring of business, fundraising or change in the capital structure of the Company.

Biximo does not sell your personal data and does not share it with data brokers or with any third party for that third party’s own independent marketing purposes.

Every service provider engaged by Biximo is bound by contract to process your information solely on Biximo’s instructions and for the purposes specified by Biximo, to apply reasonable security safeguards, and to delete or return the information upon conclusion of the engagement. On written request to Biximo, we will provide you with the identities of the service providers with whom your personal data has been shared.

Biximo may anonymise or de-identify information collected from you. The use and disclosure of aggregated or de-identified information is not restricted by this Privacy Policy.

6. STORAGE AND SECURITY OF USER INFORMATION

Biximo employs reasonable security safeguards to protect your information, including transmission of data over encrypted connections; role-based access controls restricting access to personnel and service providers who require it for the performance of their functions; contractual data protection obligations upon service providers; diligence in the selection of service providers; retention of access and activity logs for a period of one year to enable the detection and investigation of unauthorised access; and periodic review of these measures.

Payment pages are operated by a payment service provider maintaining compliance with applicable payment card industry data security standards.

No system of information security is capable of guaranteeing absolute security. Biximo does not warrant that unauthorised access, disclosure, alteration or loss of information will not occur, and to the extent permitted by applicable law shall not be liable for any breach of security arising from a malicious attack, or from an error or omission not wilfully occasioned by Biximo. Biximo’s obligations in the event of a personal data breach are set out in Clause 10.

7. TRANSFER OF INFORMATION OUTSIDE INDIA

Technology and infrastructure service providers engaged by Biximo may store or process information on servers located outside India.

Transfer of personal data outside India is permitted under Section 16 of the DPDP Act, save to such countries or territories as the Central Government may restrict by notification. As at the date of this Privacy Policy, no such list of restricted countries or territories has been notified. Should a notification be issued, Biximo will comply with it and will update this Privacy Policy accordingly.

8. RIGHTS OF THE USER

As a Data Principal under the DPDP Act, you have the following rights in respect of your personal data:

  1. Right to access information, to obtain a summary of the personal data being processed by Biximo, the processing activities undertaken, and the identities of the Data Fiduciaries and service providers with whom your personal data has been shared;
  2. Right to correction, completion, updating and erasure, to have inaccurate or misleading personal data corrected, incomplete personal data completed, personal data updated, and personal data erased where it is no longer necessary for the purpose for which it was collected and Biximo is not required by law to retain it;
  3. Right to withdraw consent as set out in Clause 3;
  4. Right of nomination to nominate another individual to exercise these rights on your behalf in the event of your death or incapacity; and
  5. Right of grievance redressal to have any grievance concerning the processing of your personal data received, considered and responded to.

To exercise any of these rights, please write to the Data Protection Officer at the address given in Clause 15, from the email address registered with your account, specifying the right you wish to exercise and providing sufficient particulars to enable Biximo to identify your records. Biximo may require you to verify your identity before giving effect to a request, in order to protect your information against unauthorised disclosure. No fee is charged.

Biximo will acknowledge your request within forty-eight hours and will respond within ninety days of receipt of a complete request. Where Biximo is unable to give effect to a request in whole or in part — including where the personal data is required to be retained under applicable law, or is necessary for the establishment, exercise or defence of a legal claim, or for the prevention or investigation of fraud — Biximo will inform you of the extent of, and the reason for, its inability to comply.

9. DATA BREACH NOTIFICATION

In the event of a personal data breach, Biximo will notify the Data Protection Board of India without delay and will furnish such further particulars as the DPDP Rules require within the period prescribed.

Biximo will also notify each affected user within 72 hours of becoming aware of the breach. Such notification will describe, in clear and plain language, the nature and extent of the breach, the personal data affected, the likely consequences relevant to that user, the measures taken by Biximo to mitigate risk and prevent recurrence, the safeguards that the user may wish to adopt, and the contact particulars of the person able to respond to queries on behalf of Biximo.

Where a governmental or regulatory authority requires Biximo to disclose your information, Biximo will inform you of the request unless prohibited from doing so by the authority or by applicable law.

10. COMMUNICATION

By creating an account, placing an order or otherwise engaging with the Platform, you agree to receive communications from Biximo and its service providers by electronic means in relation to your account, your orders and the services provided to you.

Promotional and marketing communications are sent only where you have consented to receive them, and you may opt out at any time by the means described in Clause 3. You may not, however, opt out of administrative, transactional, financial, technical, legal or product safety communications including order and delivery updates, warranty correspondence and product safety or recall notices for so long as you hold an active order, account or warranty with Biximo.

Where the mobile number provided by you is registered under the National Do Not Call registry, your consent under this Clause operates as an express opt-in for the purposes of the applicable Telecom Regulatory Authority of India regulations governing commercial communications.

11. COOKIES AND TRACKING TECHNOLOGIES

The Platform uses cookies and similar tracking technologies, which record information including internet domain and host names, internet protocol addresses, browser software and operating system types, page navigation patterns, and the dates and times at which the Platform is accessed.

Cookies are used to enable essential functions such as authentication, cart retention, checkout and security; to remember your preferences; to measure and analyse usage of the Platform; and, where you have consented, for advertising purposes.

You may manage non-essential cookies through the consent facility provided on the Platform or through your browser settings. Refusal of analytics and advertising cookies will not affect your ability to browse the Platform or place an order. Disabling essential cookies will prevent the Platform from functioning correctly.

12. AUTOMATED PROCESSING

Biximo employs limited automated logic to recommend products, to suggest complementary items and to flag transactions for manual review. No decision producing a material effect upon you including a decision to decline an order, to reject a return or to restrict an account is taken by automated means alone; each such decision is reviewed by an authorised person.

13. MISCELLANEOUS

Each clause of this Privacy Policy shall be and remain separate from, independent of and severable from every other clause, except where otherwise expressly indicated or indicated by the context. A determination that one or more clauses are invalid or unenforceable shall not affect the remaining clauses, which shall continue in full force and effect.

This Privacy Policy is published in the English language. Upon written request to the Data Protection Officer, Biximo will make it available to you in Hindi or in any other language specified in the Eighth Schedule to the Constitution of India, as contemplated under the DPDP Act.

This Privacy Policy forms part of, is incorporated within, and is to be read together with our Terms of Use.

Nothing in this Privacy Policy limits or excludes any right available to you under the DPDP Act, the Consumer Protection Act, 2019, or any other applicable law.
